Contract for the erection of a Board School in the parish of Llangain, Carmarthenshire
between
Messrs. Peter Bowen, Thomas Davies and their Sureties
and
The Llangain School Board

Dated 28 April, 1875

This Indenture made the Twenty Eighth day of April, one thousand eight hundred and seventy five. Between Peter Bowen of Llanybri in the county of Carmarthen, mason and builder. Thomas Davies of Blaencwm in the parish of Llanstephan in the said county of Carmarthen, carpenter and builder. Thomas Davies of Penlanfach in the parish of Llangunnock in the same county, farmer and David Lewis of Meinillwydion in the parish of Llangain in the same county, farmer of the one part and the School Board for the district of Llangain in the said county of Carmarthen of the other part. Whereas the said Board, having with the consent and approval of the Education Department resolved to erect a schoolhouse and premises in the district of Llangain aforesaid, obtained senders for the execution of the works, have agreed with the said Peter Bowen and Thomas Davies for executing and completing the said works comprised in the specification marked 'A' and referred to in certain drawings numbered from 1 to 6 and which specification and drawings have been sealed with the seal of the said Board and signed by the said Peter Bowen and Thomas Davies for the sum of Six Hundred and Forty two Pounds and have named the said Thomas Davies (Farmer) and David Lewis as their sureties for the due performance thereof.

1. That the said Peter Bowen and Thomas Davies shall and will to the satisfaction of the said Board on their sureties in a workmanlike, substantial and lasting manner and with the best materials on or before the last day of November next erect, execute and complete the schoolhouse and premises and all other works specified and referred to in the said plans and specification including all contingent and incidental works and in case the same shall not be completed on or before the last day of November next then the said Peter Bowen and Thomas Davies shall forfeit and pay the said Board the sum of One Pound for every day after that date during which the said work shall remain incomplete and unfinished.

2. That the said PB and TD shall in carrying out the said work fulfil the directions and instructions of the said Board or their said surveyor.

3. That the said Board for the consideration aforesaid shall and will pay to the said PB and TD the sum of Six Hundred and Forty two Pounds in such instalments and at such times on the certificate of their said surveyor that the works comprised in this contract or intended so to be completed and finished.

4. Lastly for the due performance of this contract the said PB and TD,TD(farmer) and DL their sureties do jointly and severally for themselves their heirs executors and administrators are held and firmly bound by these presents in the sum of Five Hundred Pounds to the said Board to be recovered by the said Board or their successors as and for liquidated damages in case the said PB and TD shall make default in the premises.
Provided always that should any dispute or difference arise or happen between the said PB and TD and the said Board touching or concerning the said works hereby contracted to be erected, altered, repaired, executed and completed as aforesaid or touching or concerning any other matter ..........................................

In witness whereof the said parties to these presents have hereunto sat their hands and seals the day and year hereinbefore written it.
